No. 26/1, Indiqube Aura, IBIS Hotel, Bommanahalli (Bangalore), Bangalore, Bangalore South, Karnataka, India – 560068 (the “Company”, “We”, “Us”, “Basil”) operates https://yourbasil.com both as a webpage and a webapp (collectively, the “Platform”). We, at Basil, aim to adhere to the ethical standards pertaining to collection, usage and safeguarding of the information provided by You during the use of the Platform. We respect Your privacy while You access the Platform for mobiles, smart devices, and any other compatible devices and other associated applications, devices, products, online marketplaces and services managed by Us that reference to this Privacy Policy. We collect only the personal data We need to take and deliver Your orders, handle payments, provide support, run marketing (only with Your consent where required), and improve our Platform and Services. “Service(s)” would mean, including but not limited to wholesale and retail (including online commerce) of well-designed kid’s products across various categories, and such other ancillary or related activities as may be undertaken by the Company in connection therewith.

For the purposes of this Privacy Policy the term “User(s)” and wherever the context so requires “You”, “Your”, shall mean any natural or legal person who accesses or uses the Website and in the event that a natural person is representing a business entity, reference to such terms shall include a reference to such business entity as well. 

We have adopted this privacy policy (“Privacy Policy”) to inform You of: (i) the information We collect from You through the Platform; (ii) the manner of collection and processing of such information; (iii) use of such information; and (iv) the steps We take to protect it. By using the Platform, You unconditionally agree to the terms and conditions of this Privacy Policy and consent to collecting, usage, storage, processing, handling, transferring and sharing of the information submitted by You in accordance with the terms contained hereunder. Please read the Privacy Policy before using the Platform and if You do not agree with the terms and conditions of this Privacy Policy, please do not proceed further to use this Platform. Please note that the capitalized terms not defined under this Privacy Policy shall have the same meaning as assigned to such terms in the Terms and Conditions.

For legal purposes, this Policy is the notice required under the Digital Personal Data Protection Act, 2023 (“DPDP Act”).

  1. USER INFORMATION

The Platform collects certain information and data when You register or make purchases via the website or the webapp, subscribe to our communications, interact with our customer support, or otherwise transact with us in India. It also covers data processed on Our behalf by third-party service providers (payment processors, delivery partners, analytics providers, marketplaces, etc.). Where relevant, We distinguish between “Data Principal” (You) and “Data Fiduciary” (Basil) as used in the DPDP Act. There are two types of information being collected: (i) User Information; and (ii) automatically collected information (“Auto-Collected Info”) during the usage of the Service(s).

  1. User Information and Access

  1. We collect Your Information when You successfully submit information while creating Your account and/or while availing our Services on our Platform. While doing so, We may collect data that can be used 

    1. to uniquely identify or contact a person and/or the business entity that a person represents and shall include, but not be limited to, information regarding Your name, name of the business entity that You represent, address and telephone number of the business entity, Your e-mail address, information associated to Your social networking platform and such other information for the purposes of identification and verification. We may also ask You to share the OTP sent via SMS or a password or to verify a link sent on Your e-mail address. While You are using our Platform, We record Your responses and activity data, including but not limited to, textual and voice responses and session details. We do not directly process any payments and do not store Your debit/credit card information. Secured socket layer technology is used for processing payment transactions with third party service provider partners. When You submit User Information on the Platform, it shall be deemed that You have granted Us the right to collect, store, process, handle and use such User Information, in accordance with this Privacy Policy (as amended from time to time). Further, You agree and consent to receive all communications related to our services on the mobile number provided by you to the Company, even if such mobile number is registered under DND/NCPR list under the Telecom Commercial Communications Customer Preference Regulations, 2018 (“TRAI Regulations”).


    1. We may ask for permission to access Your data storage. However, the data storage access shall be limited to the access to store the data downloaded or saved during the usage of the Platform or the products directly in the User’s device for ensuring easy storage and access to the User. We shall not utilize this permission to access any other data on the User’s device, except as expressly mentioned in this Privacy Policy.

The said information collected from the Users could be categorized as “Personal Information”, “Sensitive Personal Information” or other information and would be governed in accordance with the DPDP Act, together with any rules, notifications, or directions issued thereunder. To the extent applicable, Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (the “IT Rules”), Consumer Protection (E-Commerce) Rules, 2020 or Information Technology (Intermediary Guidelines & Digital Media Ethics Code) Rules, 2021 and other relevant applicable laws of the jurisdiction may also apply. For the purposes of this Policy, all such information will collectively be referred to as “User Information” in this Policy.


    1. We may use the User Information to contact You from time to time, to provide You with the services We offer through the Platform, important information and circulate marketing and promotional material in relation thereto. The User shall be permitted to access the Platform via any device provided that the log in/access credentials match with the User credentials. 


    1. You may visit the Platform and browse the Platform without having to provide User Information. We will, at all times, provide the option to You to not provide the Personal Information or Sensitive Personal Information, which We seek from You. Where possible, We indicate which fields are mandatory and which fields are optional to be filled on the Platform. You always have the option to not provide information by choosing not to submit particular information or feature on the Platform. In such event, however, the Company fully reserves the right not to allow further usage of the Platform or provide any Services/products thereunder to You.

By using this Platform, You consent to the collection, storage, use and transfer of the User Information that You provide in connection with any of the Services that We offer through our Platform, and You consent to our collection of any changes or updates that you may provide to the User Information. We collect only such User Information that We believe to be relevant for the purpose of identification and verification and is required to understand You or Your interests. It is clarified that We shall not be liable, for any reason whatsoever, for the authenticity of any User Information provided by You to Us. You hereby confirm that the User Information provided by You is and shall continue to be valid, true and accurate to the best of Your knowledge.

    1. Although our products may be used by children, our Platform is intended only for use by individuals above eighteen (18) years. We collect personal data relating to children only through their parents or legal guardians and only to the extent necessary to deliver our products.

If any portion of the User Information relates to a minor (i.e., an individual under the age of 18 years) or to a person of unsound mind, You shall ensure that such information is shared only with the verifiable consent of the parent or lawful guardian, as required under the DPDP Act. By providing such information, You represent and warrant that verifiable consent has been obtained from the parent or lawful guardian. 


    1. Your personal data may be stored or processed on servers located outside India (for example, by our cloud hosting or analytics partners). In such cases, We ensure that transfers are made in compliance with applicable laws, including the DPDP Act.

    2. Checkout & orders: delivery address, billing address, GSTIN (if provided), preferred delivery instructions;

    3. Payments: We do not collect full card details on our servers - payment details are processed by third-party payment processors (“PSPs”) such as Razorpay / Easebuzz / PayU; we may store payment tokens or transaction IDs returned by PSP;.

    4. Customer support: chat transcripts, emails, call recordings (where consented/stated);

    5. Marketing preferences and opt-ins (email / SMS / WhatsApp opt-ins);

    6. Reviews & feedback: any content You post publicly (product review, photos).

    1. Technical data: IP address, browser type and version, device type, operating system, device identifiers, crash logs, and language settings.

    2. Usage data: pages visited, timestamps, referral URLs, session duration, items viewed, cart behaviour.

    3. Cookies & tracking identifiers (see Section C). these power targeted advertising (retargeting) on platforms such as search engines and social media.

    This type of information does not identify You personally during Your visit to the Platform. We can identify You only after You submit User Information at the time of registering Yourself with the Platform.

    1. Marketplace orders: if You purchase via third-party marketplaces, the marketplace may share order/delivery data with us;

    2. Social login or advertising networks: if You use social login or click on ads, partners may share identifiers or profile data.

    We use personal data for the following purposes:

    1. Order fulfilment & customer service — to process Your order, confirm stock, arrange manufacture / packaging, arrange shipment, share delivery details with logistics partners, and respond to returns, refunds, cancellations and queries. (Necessary for contract performance.)

    2. Payment processing & fraud prevention — to complete payments, process refunds, reconcile transactions, and detect and prevent fraud. (Processed via PSPs; We may share transaction details with banks/PSPs.)

    3. Manufacturing & fulfilment coordination — to share order specifications with third-party manufacturers or packers (e.g., for bespoke/customised orders or drop-ship fulfilment) where necessary to produce or ship the product. We share only the minimum data necessary for fulfilment (typically product, quantity, delivery name & address, phone).

    4. Customer support & dispute resolution — to operate call/chat support and to keep records of interactions (chat logs, call recordings where local law requires notice/consent).

    5. Marketing & advertising (with consent where required) — to provide personalized recommendations and maintain general and personalized content, to send transactional messages (order confirmations, delivery updates) and, if You opt in, promotional emails/SMS/WhatsApp and personalised ads using permitted identifiers and advertising platforms. WhatsApp promotional or template messages follow WhatsApp Business guidelines (templates and opt-in requirements) and We keep records of opt-ins and SMS follows TRAI guidelines, as required. 

    6. Analytics & improvement — to analyse Website usage, run A/B tests, and improve product assortment and the shopping experience (via analytics providers and aggregated, anonymized metrics).

    7. Legal compliance & safety — to comply with tax, audit and other statutory obligations (e.g., retention for accounting), to respond to lawful requests from authorities, and to protect our rights and customers against abuse/fraud.

The User Information is being collected by the Company and the Company will delete any User Information upon the User withdrawing the consent in writing, however, upon the withdrawal of the consent by the User, the Company may, at its option, not provide any Services for which the User Information was sought and the User shall not claim deficiency of services on the basis of such non provision of goods and Services. 


    1. To enhance Your use of the Platform, certain information may be collected each time You visit the Platform which are saved in server logs. It is clarified that these statistics help Us in improving the efficiency of the Platform by giving Us information relating to Your use of the Platform. Such information may include details of the server from where the Platform is being accessed, the browser and operating system used to browse the Platform, details of Your last visit to the Platform, including time, date and the duration of Your session on the Platform. This information is used by us to understand the number of users visiting the Platform and gather broad demographic information for aggregate use of the Platform. We have in place a secure server for all Your transactions on the Platform, which, if required to be accessed, are accessible only by Our authorized personnel. However, as You are aware, no internet site/mobile based application is completely free of security risks and We do not make any representation in respect of the same.

      1. We do not warrant that Our Platform or any electronic communication made by Us is free from virus or other harmful effects. In the event of any errors in transmission or in the event of Our Platform being inaccessible due to an act of any third party or due to any outage, or any technical or technological failure, or similar reasons beyond our control, We shall not be held liable or responsible for any losses/ damages incurred by You, and You agree that you will not have any claims against us regarding the same. You explicitly agree that Your use of the Platform and/or services is at Your own individual risk. You agree and confirm that Your User Information may be collected, used, transferred, processed and stored in the manner stipulated in this Privacy Policy. You hereby confirm that You have been made aware of the security measures undertaken by Us and You expressly consent to Us collecting, storing, handling, processing and using Your User Information.

While no system is completely secure, We implement reasonable security practices and industry-standard safeguards (such as, Secure Socket Layer (SSL) technology) in order to transmit all supplied sensitive information and then encrypt into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems and are required to keep the information confidential. After a transaction, Your private information (credit cards, social security numbers, financials, etc.) will not be stored on Our servers. While We have mechanisms in place to safeguard Your personal information after We receive it, no transmission of data over the internet can be fully secure and We make no representation in respect of the same.

  1. CHILDREN’S PRIVACY

  1. Our Services are intended for adults, parents, and legal guardians who purchase our products for children. While Basil designs and retails lunch boxes and related products suitable for children, the Website and associated Services are not directed to, and are not intended to be used by, children under the age of eighteen (18) years.


  1. We do not knowingly collect personal data directly from children. Any personal data relating to a child (for example, delivery details including the child’s name) must be provided only by a parent or legal guardian. By submitting such information, You represent and warrant that You are the parent or lawful guardian of the child, or that You have obtained the necessary verifiable consent from such parent or guardian, as required under the Digital Personal Data Protection Act, 2023.

We are not responsible for any form of transmission, whatsoever, received by You from any third party platform and accordingly do not make any representations concerning the privacy practices or other policies of such third party Platforms. Under no circumstances shall We be deem to control or guarantee the accuracy, integrity, or quality of the information, data, text, software, sound, photographs, graphics, videos, cookies, messages or other materials available on such platforms. Any User Information provided by You to such third party Platforms shall be governed in accordance with the privacy policies of such platforms and it is recommended that You review the privacy policy of such platforms prior to using such platforms.
